1. About this Privacy Policy

This Privacy Policy explains how we collect, use, store, and disclose your personal information when you visit our website, use our mobile application, or take part in our mentoring introduction and matching services (together, the "Platform").

The Platform is operated by Next Level Mentoring Pty Ltd (ACN 645 302 889, ABN 80 645 302 889) ("Next Level Mentoring", "NLM", "we", "us", "our"). Where this policy uses a defined term such as Mentee, Mentor, Match, or Mentoring Relationship, it has the same meaning as in our Terms of Use.

We respect your right to privacy and we are committed to protecting it. We handle personal information in accordance with the Australian Privacy Principles in the Privacy Act 1988 (Cth). Our Platform is available internationally, and if you access it from outside Australia, local privacy laws may give you additional rights. Section 8 explains how this works.

In this policy, "personal information" means information we hold that identifies you or could reasonably identify you.

 

2. The personal information we collect

If you visit our website. We may collect basic contact details you choose to provide, such as your name, email address, phone number, and any message you send us through an enquiry or contact form.

If you register on the Platform as a Mentee or Mentor. We collect the information you provide when you create and maintain your account, including your name, email address, gender, country, region or state, town, industry, career level, and years of experience. If you choose to provide them, we also collect a profile photo and your LinkedIn profile URL. We collect the free-text answers you provide, such as what you are looking for in a mentor or what you can offer as a mentor, together with your preferences for who you are matched with.

To confirm your eligibility. We collect your date of birth so that we can confirm you are at least 18 years of age, as required by our Terms of Use.

If you use the app on a mobile device. We collect a push notification token so that we can send you updates about your Matches. You can disable push notifications at any time through your device settings.

If you were referred. If you sign up through a personal referral link shared by another user, we record that you were referred by them.

In the future. We may ask for additional information, such as a mobile phone number, to support a premium service. If we do, we will tell you why at the time.

Sensitive information. Some of the information you choose to share, for example a profile photo or free-text answers, may include sensitive information as defined in the Privacy Act. We collect this only where you provide it and where it is reasonably needed to provide the Platform. Please do not include sensitive details you would prefer not to share in free-text fields.

 

3. How we collect your personal information

We collect personal information directly from you when you enquire, register, complete your profile, correspond with us, or use the Platform. We collect some technical information automatically when you visit our website, as described in section 15. On occasion we may receive personal information from a third party, such as another user who refers you. If we receive information about you from a third party, we protect it in line with this policy.

 

4. Why we use your personal information

We use your personal information to:

(a) operate the Platform, including creating your profile, suggesting and managing Matches, enabling Mentoring Relationships to begin, and delivering our mentor and mentee training;

(b) communicate with you, including sending account updates and Match notifications by email and push notification, and responding to your enquiries;

(c) keep the Platform safe, including reviewing Mentor profiles, investigating reports, and enforcing our Code of Conduct;

(d) understand how the Platform is used so that we can improve it;

(e) let you know about other Next Level Mentoring products, services, and opportunities, where you have not opted out, as described in section 9; and

(f) meet our legal obligations.

We use your personal information for the purposes for which it was collected, for a related purpose you would reasonably expect, or where you have consented. We do not use sensitive information for marketing.

 

5. How Matches are suggested, and the part people play

We want to be clear about how Matches come about, because it involves both software and people.

Automated shortlisting. When you register as a Mentee, the Platform uses your stated preferences and your profile information to generate a shortlist of up to four Mentors that it identifies as a potential fit. This first step is automated.

Human review and your choice. A person at Next Level Mentoring reviews Mentor profiles before they are made visible. You then decide which, if any, of the shortlisted Mentors you would like to proceed with, and the Mentor decides whether to accept. The decision to make a Match, to accept it, and to begin any Mentoring Relationship rests with you and the Mentor, not with the Platform. A Match is a suggestion only.

The automated shortlisting does not, on its own, make any decision that significantly affects your rights or legal interests. If you would like to understand how the shortlisting works, or you have a concern about a shortlist, you are welcome to contact us using the details in section 20.

 

6. Information shared with a matched user

Once a Match is confirmed, the person you are matched with will see your name, your role and career information, your location, your photo and LinkedIn profile if you have provided them, and your email address, so that a Mentoring Relationship can begin. We share these details with your matched user in reliance on the consent you give when you accept our Terms of Use and choose to proceed with a Match.

We encourage you to follow the safety guidance in our Terms of Use and Code of Conduct, including holding early conversations by video call and being thoughtful about what personal details you share and when.

 

7. Who else we share your information with

We share personal information with trusted service providers who help us operate the Platform. At present these are:

(a) Kajabi, which delivers our mentor and mentee training through an online learning portal;

(b) Supabase, which securely stores your information on servers located in Sydney, Australia; and

(c) Resend, which delivers our account and Match notification emails.

Some of these providers, or their parent companies, are located outside Australia. Where we disclose your information to a provider overseas, we take reasonable steps to ensure it is handled consistently with this policy and the Australian Privacy Principles. We may also disclose personal information to our professional advisers or insurers where reasonably necessary, or where we are required or authorised to do so by law, such as in response to a court order or a lawful request from an enforcement agency.

We do not sell your personal information to anyone.

 

8. Overseas users and cross-border information

The Platform is available to users in a range of countries. Wherever you use it from, your information is collected, used, and stored as described in this policy, including on servers located in Australia.

Depending on where you live, your local laws may give you additional rights over your personal information. For example, if you are in the United Kingdom or the European Economic Area, data protection law there may give you rights to access, correct, erase, port, or object to the use of your information, and to withdraw consent. If those laws apply to you, please contact us using the details in section 20 and we will respond to your request as required by the applicable law.

 

9. Direct marketing and your choices

From time to time we may send you information about Next Level Mentoring news, products, and services. You can opt out at any time by using the unsubscribe link in the message or by emailing us, and we will action your request promptly. Account and Match notifications are service messages that are part of running the Platform, rather than marketing, and you manage push notifications through your device settings.

 

10. Keeping your information secure

We take the security of your information seriously. We use reasonable technical and organisational measures to protect personal information from misuse, interference, and loss, and from unauthorised access, modification, and disclosure. Your account information is stored with Supabase on servers located in Sydney, Australia.

No method of transmission or storage is completely secure, and some risk remains in sending information over the internet. If something does go wrong, we act promptly, as described in section 11.

 

11. If a data breach occurs

We maintain a plan for responding to data breaches. If a breach of personal information is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required under the Notifiable Data Breaches scheme in the Privacy Act, and we will notify any other regulator where the law requires it.

 

12. How long we keep your information

We keep personal information only for as long as we need it for the purposes described in this policy, or for as long as the law requires, after which we destroy or de-identify it.

Deleting your account. You can delete your account at any time from within the app, under Dashboard, then Delete my account. When you delete your account: any current Match ends immediately and the other party is notified; your profile is permanently removed from matching and search; your name and email address are replaced with a generic placeholder; and you will not be able to sign back in. Records that also involve other users, such as a completed mentorship or a report, are retained for our records but will display as "Deleted user" rather than your name.

 

13. Accessing and correcting your information

You have the right to ask for access to the personal information we hold about you, and to ask us to correct it if you believe it is inaccurate, out of date, incomplete, irrelevant, or misleading. Much of your information you can view and update yourself within the app. For anything else, please email us at [email protected], and we will respond within a reasonable time, usually within 30 days.

We do not charge you to make a request. If giving you access would involve substantial work, we will discuss any reasonable cost with you first, and we will not charge more than is necessary. In the limited circumstances where the Privacy Act allows us to refuse access or correction, we will let you know why in writing.

 

14. Dealing with us anonymously

Where it is lawful and practicable, you may deal with us anonymously or by using a pseudonym, for example when making a general enquiry through our website. For our matching services, we need your real details so that Mentees and Mentors can be introduced to one another and connect safely.

 

15. Cookies and website analytics

When you visit our website, we may collect information such as your browser type, device, operating system, the website you visited immediately before ours, and the pages you view. We use this information in an aggregated way to understand how people use our site so that we can improve it. We may use cookies, which are small files that help a website recognise you and remember your preferences. Most browsers accept cookies automatically, and you can change your browser settings to reject them, although some parts of the site may not work as well.

We do not currently use cookies to serve you advertising. If this changes, we will update this policy and seek your consent where the law requires it.

 

16. Reports about other users

If you report a concern about another user, we record the details of that report so that we can review and act on it. We use this information only to investigate the report and to maintain the safety of the Platform, and we do not share it with the user who is the subject of the report.

 

17. Children

The Platform is intended for adults only. You are asked to confirm that you are at least 18 years of age when you register, and the Platform is not directed at children. If we become aware that a user is under 18, we will remove their account.

 

18. Complaints

If you have a concern or complaint about how we have handled your personal information, please contact us first, using the details in section 20, so that we can try to put things right. We take complaints seriously and will respond promptly.

If you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner at www.oaic.gov.au or on 1300 363 992. If you are outside Australia, you may also have the right to complain to the privacy regulator in your own country.

 

19. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. Any changes take effect when we post the updated policy on our website or in the app. If we make a material change, we will take reasonable steps to let you know. Please check the "last updated" date at the top of this policy so that you are aware of the current version.
